Role and responsibility

The commanding officer provides supporting documentation to and directs the member to report to the servicing law enforcement agency (NCIS, CID, PMO, or other) within 5 working days of notification or disposition per MCBUL 5810 of 22 May 2024 enclosure 2. The S-1 officer signs by direction on the routing of the supporting documentation. The S-1 chief tracks pending CJIS reports against the 5-working-day window. The legal clerk processes the documentation package and maintains the report copy in the unit legal file. The commander counsels prohibited persons on federal firearm restrictions and implements unit armory access controls.

Source documents flow from the disposition action (civilian court restraining order, NJP finding for controlled substance, SCM or SPCM or GCM verdict, civilian conviction for domestic violence, GCM referral, finding of incompetence to stand trial, finding of not guilty by reason of lack of mental responsibility, or UA/deserter status following preferral), the supporting documentation from the case file, and the disposition record. CJIS outputs include the report to the servicing law enforcement agency, the supporting documentation package, the prohibited person counseling letter, the unit armory access control implementation, and the retained report copy in the unit legal file.

Per MCBUL 5810 of 22 May 2024 enclosure 2, the 5-working-day clock runs from disposition or notification. The categories cover civilian court restraining orders, SPCM/GCM/civilian court domestic violence convictions, Article 112a controlled substance findings at NJP/SCM/SPCM/Admin Separation, GCM referrals, GCM convictions of any offense punishable by more than 1 year, GCM domestic violence findings, findings of incompetence to stand trial, findings of not guilty by reason of lack of mental responsibility, and UA/deserter status following preferral of charges.

Trigger events

• Civilian court issues a restraining order against a unit member.
• Civilian court convicts a unit member of a crime of domestic violence.
• SPCM or GCM convicts a member of a crime of domestic violence.
• NJP, SCM, SPCM, or Admin Separation finds wrongful use of a controlled substance under Article 112a.
• Charges referred to a GCM.
• GCM convicts a member of any offense punishable by more than 1 year confinement regardless of confinement awarded.
• GCM finds a member of domestic violence under the MCBUL 5810 definition.
• SPCM or GCM finds a member incompetent to stand trial or not guilty by reason of lack of mental responsibility.
• A member enters UA or deserter status following preferral of charges.
• IGMC Legal Administration FA inspection covers Criminal Justice Information Reporting.

Processing workflow

1. Identify the reporting trigger. Per MCBUL 5810 of 22 May 2024 enclosure 2, the disposition triggers a CJIS report. Categories cover civilian court actions, court-martial verdicts, Article 112a findings, and post-preferral UA/deserter status.
2. Document the disposition with supporting evidence. The S-1 staff stage the disposition record (court-martial verdict, civilian court order, NJP UPB entry, Admin Separation finding) and the supporting evidence package.
3. Direct the member to report to the servicing law enforcement agency. Per MCBUL 5810 enclosure 2, the commanding officer directs the member to report to NCIS, CID, PMO, or other servicing law enforcement agency.
4. Provide supporting documentation to the law enforcement agency. The commander forwards the supporting documentation package to the agency. The S-1 retains a copy.
5. Complete the report within 5 working days. Per MCBUL 5810 enclosure 2, the report runs within 5 working days of disposition or notification.
6. Counsel prohibited persons. Per MCBUL 5810 enclosure 2 and 18 U.S.C. 922(g), the commander counsels in writing a "prohibited person" to abide by federal law pertaining to restricted access to personally owned firearms and ammunition and to make arrangements to dispose of all such items.
7. Implement unit armory access control. Per MCBUL 5810 enclosure 2, the unit implements a procedure ensuring a prohibited person does not access privately owned firearms stored in unit armories. The commander documents the procedure.
8. Retain the CJIS report copy. The legal clerk files the report copy in the unit legal file labeled per SECNAV M-5210.2.
9. Update MCTFS. Cut the disposition transaction in MCTFS per MCTFSPRIUMMCTFSPRIUM.
10. Brief CJIS reporting posture. The S-1 officer briefs the commander on open and closed CJIS reports on the monthly cycle.

Common pitfalls

• CJIS report past 5 working days. Per MCBUL 5810 enclosure 2, the report runs within 5 working days of disposition or notification.
• Member not directed to report to the servicing law enforcement agency. The commander's direction is required per MCBUL 5810 enclosure 2.
• Supporting documentation incomplete. The package carries the disposition record, the underlying offense documentation, and the unit's pre-existing documentation.
• Prohibited person counseling skipped. Per MCBUL 5810 enclosure 2 and 18 U.S.C. 922(g), the counseling is required.
• Unit armory access control not implemented. Per MCBUL 5810 enclosure 2, the unit's procedure documents the access control for prohibited persons.
• CJIS report copy not retained. Per SECNAV M 5210.1, the legal file holds the report. Without the copy, the audit trail breaks.
• MCTFS disposition transaction skipped. The pay and personnel record diverges from the legal record.
