Role and responsibility
S-1 admin specialists and IPAC pay clerks deliver the due process notification on debts owed by Marines and route the salary offset start through DFAS. The S-1 chief verifies the debt validation against the source transaction before the demand letter goes out. The IPAC pay clerk loads the salary offset transaction in MCTFS per the demand letter timeline. The S-1 officer signs by direction on the demand letter delivery record and the due process certification.

DoDFMR Vol 16 Chapter 2 is the framework for every DoD debt collection action. Marine pay debt routes through Vol 7A Chapter 50 for waivers and remissions, but the underlying due process and collection mechanics route through Vol 16 Chapter 2.

Processing workflow
- Validate the debt. Trace the debt to the source transaction and the supporting KSD per DoDFMR Vol 16DoDFMR Vol 16 Chapter 2. The debt is valid only with a documented source.
- Issue the initial demand letter. The demand letter notifies the Marine of the debt, the basis, the amount, the right to inspect records, the right to dispute, the right to a hearing, the right to apply for a waiver or remission, the right to repay voluntarily, and the consequences of nonpayment per DoDFMR Vol 16DoDFMR Vol 16 Chapter 2.
- Track the due process timeline. The Marine has 30 days from the demand letter to dispute, request a hearing, apply for waiver remission, or arrange voluntary repayment per DoDFMR Vol 16DoDFMR Vol 16 Chapter 2.
- Process the Marine response. The S-1 chief routes dispute requests to the hearing process at hearings-informal-disputes-and-waivers-remissions. The S-1 chief routes waiver remission applications under DoDFMR Vol 16DoDFMR Vol 16 Chapter 4 and Vol 7A Chapter 50.
- Start salary offset. On expiration of the 30-day window without dispute or repayment arrangement, the IPAC pay clerk starts salary offset per 5 USC 5514 and DoDFMR Vol 16DoDFMR Vol 16 Chapter 2. Salary offset caps at 15 percent of disposable pay for routine debt.
- Process administrative offset. For tax refund offset, vendor payment offset, or other federal payment offset, the salary offset extends to administrative offset per 31 USC 3716.
- Process administrative wage garnishment for separated Marines. After separation, debt collection extends to private-sector wages per 31 USC 3720D and DoDFMR Vol 16DoDFMR Vol 16 Chapter 2 with a 30-day notice and hearing right.
- Add interest, penalties, and administrative costs. Per 31 USC 3717 and DoDFMR Vol 16DoDFMR Vol 16 Chapter 7, interest accrues on delinquent debt, penalties apply after 90 days delinquent, and administrative costs route through DFAS.
- Refer delinquent debt to Treasury. After 120 days delinquent, DFAS refers the debt to Treasury Offset Program (TOP) per 31 USC 3716 and DoDFMR Vol 16DoDFMR Vol 16 Chapter 2.
- Report to credit bureaus. Per DoDFMR Vol 16DoDFMR Vol 16 Chapter 2, DFAS reports delinquent debt to credit bureaus after the 30-day due process window and 60 days delinquent.

Common pitfalls
- Demand letter missing due process language. The salary offset is procedurally defective. Include every Vol 16 Ch 2 required element in the demand letter.
- 30-day window not tracked. Salary offset starts late and interest accrues. Calendar the 30-day window at the moment of demand letter delivery.
- Salary offset exceeds 15 percent of disposable pay. The Marine disputes and the offset rolls back. Apply the 15 percent cap per 5 USC 5514 and DoDFMR Vol 16DoDFMR Vol 16 Chapter 2.
- Administrative wage garnishment without notice. The garnishment is procedurally defective. Issue the 30-day notice per 31 USC 3720D before the garnishment routes to the employer.
- Interest and penalty miscalculation. Per DoDFMR Vol 16DoDFMR Vol 16 Chapter 7, interest accrues from the date of the initial demand letter at the Treasury current value of funds rate. Penalty applies after 90 days delinquent at 6 percent per annum.
