CASUALTY INVESTIGATION TRACKING is the HQMC section that tracks all command investigations and preliminary inquiries regarding the death of Marines. Investigations are required for. LINE OF DUTY DETERMINATIONS (LODD) per JAGMAN PART E SECTION 0212. Required for Uniformed Services Survivor Benefit Program eligibility and annuity calculations per Part F Section 0229. COMMAND INVESTIGATIONS are conducted for the GENERAL COURT MARTIAL CONVENING AUTHORITY to determine if the Marine was in or out of the line of duty at the time of death. Investigations may be conducted alongside NCIS (Naval Criminal Investigative Service), CID (Criminal Investigation Division), and the Naval Safety Center. Investigation information is provided to next of kin (NOK) THROUGH THE ASSIGNED CACO until the full redacted investigation is delivered and all questions answered. 800-847-1597 or usmc-investigations@usmc.mil. What Investigation Tracking Does

The Investigation Tracking section at HQMC.

• Tracks all command investigations and preliminary inquiries on Marine deaths.
• Ensures timely and accurate investigation information flows to next of kin through CACOs.
• Provides education, training, and assistance to Marine Corps commands on investigation requirements.
• Coordinates with other investigative agencies (NCIS, CID, Naval Safety Center).
• Maintains the institutional record of investigation status and outcomes.

Why Command Investigations Are Required

Command investigations are required for two primary purposes.

Line of Duty Determinations (LODD)

Per JAGMAN Part E Section 0212 paragraph B.

"A line of duty determination is required whenever an active duty service member of the Naval service dies, in order to make decisions concerning eligibility and annuity calculations under the Uniformed Services Survivor Benefit Program; see Part F, section 0229 of this Manual. In many cases, the death of a reservist will also require a line of duty determination. See section 0224 for additional information on reservist personnel."

LODD is the foundational determination affecting downstream benefits eligibility.

General Court Martial Convening Authority Determination

Command investigations are conducted FOR THE GENERAL COURT MARTIAL CONVENING AUTHORITY to determine if the Marine was IN or OUT of the line of duty at the time of death.

• "In line of duty" generally means the Marine was performing authorized duties or was in an authorized status when the incident occurred.
• "Out of line of duty" generally means the death resulted from misconduct, willful negligence, or unauthorized activities.

Why The Distinction Matters

• Survivor Benefit Program eligibility depends on LODD outcome.
• Annuity calculations depend on LODD outcome.
• Other benefits (DIC, certain insurance) may depend on LODD.
• Command and institutional learning may differ based on LODD outcome.

Who Conducts Investigations

Command Investigation

• Conducted by the Marine Corps command holding the Marine.
• Convened by the commanding officer.
• Investigating Officer appointed.
• Witnesses interviewed, evidence gathered, report drafted.
• Reviewed by chain of command.
• Final action by General Court Martial Convening Authority.

Naval Criminal Investigative Service (NCIS)

NCIS may investigate alongside the command in cases involving.

• Suspected criminal activity (homicide, assault, other crimes).
• Suspicious circumstances.
• Death involving non-military personnel.

Criminal Investigation Division (CID)

Army CID may investigate in joint-service or installation cases involving Army equities.

Naval Safety Center

Naval Safety Center investigates in cases involving.

• Aviation mishaps.
• Mishaps involving naval ships, equipment, or operations.
• Identifies root causes and prevention recommendations.

Coordination Pattern

When multiple agencies investigate, they coordinate to.

• Avoid duplication of witness interviews.
• Share evidence under appropriate authorities.
• Develop consistent factual baseline.
• Issue separate reports per agency authorities.

Information Flow To Next Of Kin

Through Assigned CACO

Investigation information is provided to next of kin THROUGH the assigned CACO.

• CACO maintains regular contact with the family.
• CACO receives updates from Investigation Tracking.
• CACO conveys updates to the family.
• Family questions go through CACO to Investigation Tracking.

Personal Casualty Report (PCR) Updates

As investigation develops, the PCR is updated. Updated PCR information flows to NOK through CACO.

Final Redacted Investigation

When the investigation completes.

• Report is finalized.
• Redactions applied to protect privacy and classified information.
• Redacted report delivered to NOK via CACO.
• CACO answers questions about the report.

Indefinite Question Support

The Investigation Tracking section ensures questions are answered until ALL investigation-related questions from NOK are resolved. This may extend months or years after the death.

Reservist-Specific Considerations

Per JAGMAN Part E Section 0224, the death of a reservist may also require LODD.

When LODD Required For Reservists

• Death during active duty status.
• Death during inactive duty training.
• Death during travel to or from training.
• Death where the connection to military service is at issue.

When LODD Not Required For Reservists

• Death in a purely civilian status with no military connection.
• However, even in civilian status, certain benefits may depend on military service history, so review of circumstances is conducted.

Reservist Investigation Coordination

• Reserve unit command initiates investigation.
• Coordination with active component for installation or training site equities.
• Same JAGMAN framework applies.

Connection To Survivor Benefit Program

Per JAGMAN Part F Section 0229, the Survivor Benefit Program (SBP) eligibility and annuity calculations DEPEND on the LODD outcome.

In Line of Duty (Favorable LODD)

• Full SBP eligibility for surviving spouse and dependents.
• DIC eligibility likely (subject to VA determination).
• Other benefits flow per regulation.

Out of Line of Duty (Unfavorable LODD)

• Reduced or eliminated SBP eligibility.
• DIC may be denied or reduced.
• Other benefits may be affected.

Why Family Should Care About LODD Process

The LODD outcome has direct, lasting financial implications for surviving family. CACO and Investigation Tracking work to ensure the investigation is thorough, fair, and reflects the actual circumstances.

Common Timelines

Initial Investigation

• Convened within days of the casualty.
• Investigating Officer appointed.
• Initial witness interviews within first weeks.

Investigation Completion

• Variable timeline. Simple cases may complete in 30 to 60 days. Complex cases (multiple agencies, criminal proceedings, classified equities) may take 6 months to 2+ years.

Report Delivery to Family

• After completion and redaction.
• Within reasonable time after completion.
• CACO and Investigation Tracking coordinate delivery.

Family Questions and Follow-Up

• Indefinite. Family may have questions years later as life events trigger benefits review or curiosity.
• Investigation Tracking maintains the file and answers questions ongoing.

• Acknowledgment within reasonable time.
• Substantive response after research.
• Some questions may take time if investigation is ongoing or classified.

Common Failure Points

Investigation Delays

Complex investigations take time. Family may experience information vacuum.

Mitigation. CACO maintains regular contact even when no new information is available. Honesty about timeline expectations.

Missing Information

Some questions cannot be answered due to.

• Ongoing criminal investigations (information protected).
• Classified equities.
• Privacy of other personnel involved.

Mitigation. CACO and Investigation Tracking explain what cannot be shared and why.

Outcome Disagreement

Family may disagree with the LODD outcome or other findings.

Mitigation. Process for review and appeal exists. LTAP and Gold Star Representative can help navigate.

Communication Gaps Across Agencies

Multiple agencies investigating can produce inconsistent or delayed information.

Mitigation. Investigation Tracking coordinates across agencies and provides consolidated information to family.
