Confinement Administration

Role and responsibility

S-1 admin specialists process the confinement order package and coordinate with the brig. The S-1 clerk receives the pretrial confinement order from the convening authority or the trial counsel, builds the confinement order packet, and routes through the chain of command. The S-1 chief verifies the 48-hour magistrate review timeline, the 7-day initial review hearing, and the MCTFS confinement transaction. The S-1 officer signs by direction on the confinement order delivery to the brig and the prisoner control register entry.

Outputs include the confinement order package, the MCTFS confinement transaction, the brig prisoner control register entry, Page 11 entries, and the confined Marine pay reconciliation per DoDFMR Vol 7A Chapter 48.

MCAAT and IGMC inspect the confinement order package for the 48-hour magistrate review, the 7-day initial review hearing, and the MCTFS transaction. Missing reviews trigger findings and confinee release risk.

Trigger events

• Commander or military magistrate orders pretrial confinement post-apprehension or post-arrest.
• Court-martial sentence includes confinement (general, special, or summary court-martial).
• Special court-martial or general court-martial adjudges a punitive discharge with confinement.
• Civilian apprehending agency releases the Marine to military custody pending charges.
• The brig requests transfer of a confinee to a regional brig or the Naval Consolidated Brig.

Processing workflow

1. Receive the confinement order. Pull the order from the convening authority, the military magistrate, or the court-martial convening order. Verify the basis (pretrial, court-martial sentence, civilian holdover).
2. Build the confinement order packet. Include the confinement order, the Marine record summary, the medical screening, the property inventory, and the prisoner control register entry per MCO 1640.6MCO 1640.6.
3. Coordinate with the brig. Notify the receiving brig of the pending confinement. The brig confirms bed space, medical screening requirements, and arrival window.
4. Deliver the Marine. Escort the Marine to the brig with the confinement order packet. The brig receiving officer signs the chain of custody record.
5. Cut the MCTFS confinement transaction. Submit through UD-MIPS per MCTFSPRIUMMCTFSPRIUM with the confinement order as the KSD. The transaction triggers pay implications per DoDFMR Vol 7ADODFMR Vol 7A Chapter 48 court-martial confinement or pretrial pay rules.
6. Verify the 48-hour magistrate review. The initial review by a neutral and detached officer happens within 48 hours of pretrial confinement per JAGINST 5800.7GJAGINST 5800.7G Chapter 5.
7. Verify the 7-day initial review hearing. The Initial Review Officer (IRO) hearing happens within 7 days of pretrial confinement per JAGINST 5800.7GJAGINST 5800.7G Chapter 5.
8. Process Page 11 entries. Document the confinement order, the basis, the review dates, and the confinement facility per MCO P1070.12K paragraph 4006.
9. Track confinee status. The S-1 chief tracks confinement duration, sentence credit (Allen credit, RCM 305(k) credit), transfer to regional brig, and projected release date.
10. Reconcile records on release or transfer. Cut the MCTFS release or transfer transaction. Restart pay or restore allowances per DoDFMR Vol 7ADODFMR Vol 7A Chapter 48 paragraph 480107 on release.

Common pitfalls

• 48-hour magistrate review missed. The pretrial confinement is unlawful and the confinee must be released. Calendar the 48-hour review at the moment of pretrial confinement per JAGINST 5800.7GJAGINST 5800.7G Chapter 5.
• 7-day IRO hearing missed. The pretrial confinement loses legal basis. Calendar the 7-day hearing at the moment of pretrial confinement.
• MCTFS confinement transaction cut late. Pay continues at full rate during confinement. Cut the transaction the day of confinement per MCTFSPRIUMMCTFSPRIUM.
• Brig not notified of pending confinement. The confinee arrives without bed space and the brig refuses receipt. Notify the brig 24 hours ahead of delivery per MCO 1640.6MCO 1640.6.
• Pay restart skipped on release. The released Marine restarts full pay only on the next pay cycle. Cut the release transaction the day of release.

Decision points

• Pretrial confinement versus restriction. The Marine poses flight risk or further misconduct risk. The commander orders pretrial confinement and the magistrate validates the order within 48 hours per JAGINST 5800.7GJAGINST 5800.7G Chapter 5.
• Local brig versus regional brig versus Naval Consolidated Brig. The confinement length and the security level drive the facility decision. Short pretrial sits at the local brig. Long post-trial confinement transfers to the Naval Consolidated Brig at Chesapeake, Miramar, or Charleston per MCO 1640.6MCO 1640.6.
• Allen credit and RCM 305(k) credit. The military judge awards day-for-day Allen credit for legal pretrial confinement. Additional day-for-day credit applies under RCM 305(k) for procedurally defective pretrial confinement. The S-1 chief tracks both for sentence reduction.
