Scope
MARADMIN 267/26 amends the notification requirements in MCO 1900.16 (MARCORSEPMAN) paragraph 6303.3 and Figures 6-2, 6-2A, 6-3, and 6-3A to enforce DODI 1332.14 paragraph 5.11. A Marine who made an unrestricted report of sexual assault and is recommended for involuntary separation within one year of final disposition of the sexual assault case has the right to submit a written request to the first General Officer or Flag Officer in the Separation Authority's chain of command to review the circumstances of and grounds for the involuntary separation before the Separation Authority approves the final separation action. Applicable to the Marine Corps Total Force. Effective immediately on release.

- Purpose. Provide forthcoming changes and procedural guidance for the MCO 1900.16 paragraph 6303.3 notification requirements to enforce DODI 1332.14.
- When executing separation procedures under MCO 1900.16 paragraph 6303.3, commands must address the DODI 1332.14 notification requirements.
- Paragraph 6303.3.a addition. The notification must include the statement: A statement of the Marine's right to submit statements in accordance with reference (b), paragraph 5.11.
- Figures 6-2 and 6-3 addition. Add the following numbered paragraph to the notification letter. In accordance with DoD Instruction 1332.14, if you made an unrestricted report of sexual assault and are recommended for involuntary separation from the U.S. Marine Corps within 1 year of final disposition of your sexual assault case, you may submit a written request to the first General or Flag Officer in your Separation Authority's chain of command to review the circumstances of and grounds for involuntary separation before the Separation Authority approves the final separation action. (a) If you submit a timely request before final separation action, you may not be separated until the General Officer or Flag Officer conducting the review concurs with the circumstances of the grounds for the involuntary separation. (b) If you fail to submit the request before the final separation action is complete such request will not be considered. However, you may apply to the Board for Correction of Naval Records for consideration.
- Figures 6-2A and 6-3A addition. Add the following acknowledgement paragraph to the respondent's election form. I understand that, in accordance with DoD Instruction 1332.14 paragraph 5.11, if I made an unrestricted report of sexual assault and I am recommended for involuntary separation from the U.S. Marine Corps within 1 year of final disposition of my sexual assault case, I may submit a written request to the first General or Flag Officer in my chain of command to review the circumstances of and grounds for my involuntary separation before the Separation Authority approves the final separation action. (a) I understand that if I submit a request before final separation action, I may not be separated until the General Officer or Flag Officer conducting the review concurs with the circumstances of the grounds for the involuntary separation. (b) I understand that if I fail to submit my request before the final separation action is complete, such request will not be considered. However, I may apply to the Board for Correction of Naval Records for consideration.
- Administrative separation processing will be conducted based on the MARCORSEPMAN in effect on the date the respondent was notified.
- Marines impacted by DODI 1332.14 paragraph 5.11 who were already notified of involuntary separation before this MARADMIN released may still submit a written request to the first General Officer in the requestor's chain of command to review the circumstances of and grounds for involuntary separation before the Separation Authority approves the final separation action.
