Remedial Selection (ERSB and Junior Enlisted)

Two distinct remedial processes exist. ERSB (Enlisted Remedial Selection Board) for SNCO grades. Junior enlisted auto-remedial through MCTFS for PFC, LCpl, Cpl, Sgt. The ERSB reviews enlisted records for remedial promotion to SNCO grades when specific eligibility criteria are met (erroneous omission, denial of opportunity, PERB-corrected records, etc.). The ERSB is administered by MMPB-11 under MCO 5420.16DMCO 5420.16D and MCO P1400.32DMCO P1400.32D Chapter 3 Section 6. ERSB meets monthly (typically the second or third Wednesday). Junior enlisted remedial is largely AUTOMATIC per MARADMIN 559/23MARADMIN 559/23 when late training entries cause MCTFS to recompute the JEPES score. Marines must demonstrate DUE DILIGENCE in correcting record errors and submitting requests. ERSB (Enlisted Remedial Selection Board)

Per MCO 5420.16DMCO 5420.16D and MCO P1400.32DMCO P1400.32D Chapter 3 Section 6, the Enlisted Remedial Selection Board is the Marine Corps body that reviews enlisted records for remedial promotion to SNCO grades.

What the ERSB Authority Is

The ERSB is duly constituted by authority of the Commandant. The ERSB is authorized to review all Marine enlisted personnel records referred to it for the purpose of making recommendations concerning remedial promotion to SNCO grades.

ERSB Composition

The ERSB is composed of members representing the various divisions and staff agencies of Headquarters Marine Corps and other local commands as designated in MCO 5420.16DMCO 5420.16D.

When ERSB Meets

ERSB meets monthly. Typically the second or third Wednesday of the month.

ERSB Results

Results are finalized within 3 weeks. Marines are notified of selection or non-selection via the email address from which they sent their request.

Reasons for ERSB Approval (Per MCO P1400.32D Paragraph 3602)

Per MCO P1400.32DMCO P1400.32D paragraph 3602, the following are eligibility requirements for Marines requesting remedial consideration before the ERSB.

Reason 1. Marine's Record Not Considered

The eligible Marine's record is not considered by a regularly scheduled SNCO selection board (paragraph 3104.3).

Reason 2. Erroneously Omitted or Deleted

The Marine should have been eligible for consideration but was erroneously omitted or deleted from the list of eligible Marines.

Reason 3. Denied Promotion Opportunity Then Acquitted

The Marine is denied promotion opportunity as a result of action required by paragraph 1203 (e.g., pending UCMJ action) AND is subsequently acquitted or absolved of all responsibility.

Reason 4. Considered in Wrong Zone or PMOS

The Marine is erroneously considered in the wrong zone or PMOS or OccFld.

Reason 5. Omitted or Incorrect Eligibility Criteria

The Marine is denied promotion consideration as a result of omitted or incorrect eligibility criteria (i.e., DOR, AFADBD, PEBD).

Reason 6. TDRL Return

The Marine would have been eligible for promotion consideration but was temporarily retired (TDRL) and has since returned to active duty.

Reason 7. Court-Martial / NJP / Civil Conviction Set Aside

The Marine has a court-martial conviction, NJP, or civil conviction set aside or overturned.

Reason 8. PERB or BCNR Correction

The Marine has had fitness reports or other material in his or her official record removed or corrected by the PERB or BCNR.

Important Due Diligence Note

Marines should pay particular attention to paragraph 3602.3 pertaining to "Due Diligence." Due diligence requires the Marine to take appropriate steps to correct record errors and submit remedial requests in a timely manner.

Reason 9. PME Completed Prior to Board

The Marine completed all appropriate PME requirements (section 3300 of MCO P1400.32DMCO P1400.32D) prior to the convening date of the selection board, BUT the board did not find the Marine's PME complete during the board proceedings.

Reasons for ERSB Disapproval (Per MCO P1400.32D Paragraph 3602)

The following examples will NOT normally constitute a basis for granting remedial consideration for promotion.

Disapproval Reason 1. Material Removed That Was Not Visible to Board

Material removed from the Marine's record that COULD NOT have been seen by a regularly scheduled selection board (e.g., a fitness report removed from the OMPF that was submitted AFTER the adjournment of the board).

Disapproval Reason 2. Solely Dissatisfaction With Non-Selection

The Marine's request is based SOLELY upon dissatisfaction with the results of the selection board (i.e., non-selection).

Disapproval Reason 3. Unresolved Material in OMPF

When the Marine's request is based upon material contained in his or her record which the Marine believes is unjust AND this material has not been removed by PERB or BCNR.

Implication

Marines must first pursue PERB or BCNR removal of the disputed material BEFORE filing for ERSB. Filing ERSB without first addressing the underlying issue is futile.

Disapproval Reason 4. Submitted Then Rescinded Non-Selection Request

The Marine submitted a non-selection request to the selection board AND THEN changed his or her mind.

Disapproval Reason 5. Recent LATMOV or MOS Change

When a Marine's request is based upon a recent lateral move, change of MOS or OccFld, OR periods of time assigned to billets outside his or her MOS or OccFld, AND the Marine believes non-selection was based upon a lack of MOS or OccFld credibility.

Disapproval Reason 6. Missing or Late Submission of Fitness Reports

Missing or late submission of fitness reports is NOT grounds for ERSB approval. The Marine bears responsibility for ensuring fitness reports are properly in the OMPF.

Disapproval Reason 7. Date Gaps on MBS

Date gaps on the Master Brief Sheet (MBS) due to missing fitness reports are NOT grounds for ERSB approval.

Disapproval Reason 8. Errors on MBS

Errors on the Marine's MBS are NOT grounds for ERSB approval (correct via standard MBS correction process).

Disapproval Reason 9. Missing or Incorrect OMPF Information

Missing or incorrect information in the OMPF (e.g., awards, certificates, course completions, EXCEPT required PME) is NOT grounds for ERSB approval (correct via MMPB-22).

Disapproval Reason 10. Inaccurate MCTFS Information

Inaccurate information contained in MCTFS (e.g., erroneous PFT, rifle/pistol score) is NOT grounds for ERSB approval (correct via standard MCTFS correction process).

Disapproval Reason 11. Absence of Personal Correspondence

Absence of personal correspondence sent to the selection board (e.g., photo, letters of recommendation, fitness reports, RQS) is NOT grounds for ERSB approval.

Disapproval Reason 12. Failure to Demonstrate Due Diligence

When a Marine fails to demonstrate due diligence in correcting errors, injustices in the record, or in the submission of a request for remedial promotion consideration.

Disapproval Reason 13. Below Zone Consideration Requests

Marines requesting below zone consideration are NOT granted remedial consideration on this basis.

Disapproval Reason 14. Backdate of Existing Promotion

Requests for remedial consideration for promotion to a rank already held OR to which already selected by a promotion selection board. Instead, a request for a backdate of the promotion must be submitted to BCNR using DD Form 149DD Form 149.

Due Diligence Requirement

Per MCO P1400.32DMCO P1400.32D paragraph 3602.3, Marines must demonstrate "Due Diligence" in correcting errors, injustices, or pursuing remedial consideration.

What Due Diligence Means

• The Marine took appropriate steps to identify and correct errors before the board.
• The Marine pursued PERB or BCNR removal where required.
• The Marine submitted the ERSB request in a timely manner.
• The Marine's actions demonstrate the issue is not merely "dissatisfaction with non-selection" but a substantive procedural error.

Why Due Diligence Matters

The ERSB does not exist to redo selection boards. The ERSB exists to remedy substantive procedural errors that prevented proper consideration. Marines who failed to maintain their record cannot use the ERSB to remedy that failure.

ERSB Submission Process

Pre-Submission Review

Marines should review.

• Enlisted Promotion Manual (MCO P1400.32DMCO P1400.32D), Chapter 3, Section 6.
• SNCO PME Requirements.

Marine Initiates Request

Requests for remedial consideration MUST be submitted by the individual Marine. Command endorsement is NOT required.

Cover Letter

Cover letters should accompany ALL materials submitted to MMPB-11 for SNCO remedial consideration. Follow the sample format on the MMPB-11 website.

Submission Email

Submit via email to MMPB-11.

Processing Times

Marines should allow at least.

• 90 days for processing cases referred to the ERSB.
• 45 days for cases that are disapproved.

ERSB Monthly Schedule

Per MMPB-11.

• ERSBs held monthly.
• Typically the 2nd or 3rd Wednesday of the month.
• Results finalized within 3 weeks.
• Marines notified via the email address they sent their request from.

ERSB Phases

Phase 1. Pre-Board

MMPB-11 collects requests, validates eligibility, and prepares cases for the board.

Phase 2. Board

The ERSB convenes. Board members review cases. Decisions are made.

Phase 3. Post-Board

Per MMPB-11, the proceedings and recommendations of the ERSB are NOT disclosed or released until they are approved and signed.

During the post-board phase, MMPB-11 finalizes the official board report and prepares the select message. Once signed, results are released and posted to the MMPB-11 website. Selectees are announced via message. Non-selects are notified by email.

Junior Enlisted Auto-Remedial Process

Per MARADMIN 559/23MARADMIN 559/23, junior enlisted remedial promotions are largely automatic.

How It Works

1. Late entry of training data or command input marks occurs.
2. MCTFS automatically recomputes the JEPES score.
3. MCTFS screens whether the new score meets a previous month's cutoff.
4. If yes and the Marine is otherwise eligible, MCTFS automatically promotes the Marine in the next promotion cycle with the remedial date of rank.
5. A message is sent to the unit's JEPES module in MOL.

When Formal Request Required

Per MARADMIN 559/23MARADMIN 559/23, formal request from the commanding officer via naval correspondence is required only for.

• Correcting entry-level grades associated with a contracted PFC.
• Non-competitive IMOS promotions.
• Marine Corps Embassy Security Group PME waivers.
• Musician Enlistment Option Program promotions.
• Reservists who changed components after the requested remedial promotion date.
• Correcting a previous DOR for a Marine already promoted.

IPAC's Role

The unit IPAC can run remedial selection entries in UD/MIPS with TTC 287-003 between the 1st of the promotion month and the day before select grades are run for the following promotion month.

ERSB vs PERB

ERSB (Enlisted Remedial Selection Board)

• Reviews records for REMEDIAL PROMOTION to SNCO grades.
• Asks. Did the Marine deserve consideration that was missed?
• Outcome. Selection (or non-selection) for remedial promotion.

PERB (Performance Evaluation Review Board)

• Reviews FITREPs for SUBSTANTIVE ERROR.
• Asks. Was the FITREP procedurally and substantively correct?
• Outcome. Affirmation, remand, correction, or removal of the FITREP.

Order of Operations

If a Marine has a disputed FITREP affecting promotion eligibility.

1. Pursue PERB FIRST to remove or correct the FITREP.
2. Once PERB removes or corrects, file ERSB based on the corrected record.

Common Remedial Scenarios

Scenario 1. SNCO Marine Erroneously Omitted From Eligible Population

Marine eligible for SSgt board but was erroneously omitted from the list.

• Path. ERSB.
• Action. Marine submits request to MMPB-11 with supporting documentation.
• Result. ERSB reviews. If valid omission, Marine receives remedial consideration.

Scenario 2. SNCO Marine Acquitted After Pending UCMJ

Marine denied promotion opportunity due to pending UCMJ. Subsequently acquitted.

• Path. ERSB.
• Action. Marine submits request with court documents showing acquittal.
• Result. ERSB reviews. If acquitted of all responsibility, Marine rates remedial consideration.

Scenario 3. SNCO Marine With FITREP Removed by PERB

Marine had an adverse FITREP removed by PERB.

• Path. ERSB after PERB.
• Action. Marine submits ERSB request with PERB removal documentation.
• Result. ERSB reviews the corrected record.

Scenario 4. SNCO Marine Believes Records Are Unjust

Marine believes a FITREP in the record is unjust but has not pursued PERB.

• Path. PERB FIRST. ERSB will not consider until PERB has acted.
• Action. Marine files PERB. Awaits decision. If PERB removes or corrects, then files ERSB.
• Result. ERSB reviews based on corrected record.

Scenario 5. Junior Enlisted Marine With Late PME

Junior enlisted Marine completed PME but the entry was late.

• Path. Junior enlisted auto-remedial per MARADMIN 559/23MARADMIN 559/23.
• Action. MCTFS automatically recomputes JEPES score.
• Result. If score meets a previous month's cutoff, MCTFS automatically promotes in the next promotion cycle.

Scenario 6. Junior Enlisted MEOP Remedial

Marine in Musician Enlistment Option Program needs remedial promotion.

• Path. Formal request per MARADMIN 559/23MARADMIN 559/23.
• Action. CO submits via naval correspondence to MMPB-11.
• Result. MMPB-11 processes per the formal framework.

Common Mistakes

Mistake 1. Filing ERSB Without First Addressing PERB Issues

ERSB will not consider material that has not been removed by PERB. Address the underlying FITREP issue first.

Mistake 2. Filing ERSB Based Solely on Non-Selection Dissatisfaction

ERSB does not redo selection boards. Mere dissatisfaction is not grounds.

Mistake 3. Failing to Demonstrate Due Diligence

Marines who allowed records to remain inaccurate or who delayed requests typically face disapproval based on lack of due diligence.

Mistake 4. Requesting Below Zone Consideration

ERSB does not consider below-zone requests as a basis for remedial selection.

Mistake 5. Confusing ERSB with Backdate Request

If you are already promoted but believe the date of rank is wrong, file a BCNR request via DD Form 149DD Form 149. ERSB does not address backdates of existing promotions.

Mistake 6. Including Material the Board Could Not Have Seen

Material added to OMPF AFTER the original board adjournment was not available to the board. ERSB does not consider this material as grounds.
