Your divorce is final. You have 10 WORKING DAYS from the date of the final divorce decree to submit NAVMC 10922NAVMC 10922 to S-1 with a certified copy of the decree. BAH-with-dependents stops effective the DAY AFTER the divorce date (if no other dependents remain). Former spouse must be removed from DEERS. Former spouse must return USIP card. The 10 Working Day Timeline

Day zero is the date of the FINAL divorce decree (not separation, not interim orders).

Steps Within 10 Working Days

• Day 1 to 3. Obtain certified copies of final divorce decree from the court.
• Day 4 to 5. Complete NAVMC 10922NAVMC 10922 to remove spouse and update dependents.
• Day 6 to 8. S-1 appointment for review and submission.
• Day 9 to 10. S-1 routes to IPAC for MCTFS update and DEERS removal.

Day After Divorce - BAH Effective Date

• BAH-with-dependents continues through the divorce date.
• BAH adjusts effective the day AFTER the divorce date.
• If no dependents remain, BAH drops to without-dependents rate.
• If children or other dependents remain, BAH-with-dependents continues.

Within 30 Days

• Former spouse should return USIP card to RAPIDS or by mail.
• DEERS removal completed.

BAH Adjustment Timing

Day After Rule

Per DoD 7000.14-R Volume 7ADoD 7000.14-R Volume 7A Chapter 26, BAH-with-dependents continues through the day of the divorce decree. The rate change is effective the DAY AFTER.

When Children Remain

If you have custody or court-ordered support for children from this marriage, BAH-with-dependents continues based on the children. Specific calculation depends on custody arrangement.

When No Other Dependents

BAH drops to without-dependents rate. Past entitlement is not retroactively adjusted (no debt for the period covered).

BAH-Diff for Court-Ordered Child Support

If you do not have custody but pay court-ordered child support that exceeds the BAH-Diff threshold, BAH-Diff applies. See BAH (Housing Allowance).

Late Submission Consequences

If NAVMC 10922NAVMC 10922 submitted late and you continued receiving BAH-with-dependents past the divorce date, a debt is created. The debt represents overpayment. Recoupment via LES deductions begins after IPAC processing.

DEERS Removal and ID Card Return

Marine Initiates DEERS Removal

Submission of NAVMC 10922NAVMC 10922 with the divorce decree to S-1 triggers DEERS removal. The Marine does not personally need to attend RAPIDS for spouse removal.

Former Spouse ID Card Return

The former spouse is required to return the USIP card. Options.

• Return in person at any RAPIDS site.
• Mail to RAPIDS site.
• Return to S-1 if Marine and former spouse cooperate.

TRICARE Termination

Former spouse loses TRICARE eligibility on the divorce date UNLESS USFSPA 20/20/20 or 20/20/15 rules apply.

Continued Health Coverage Option

Former spouse may purchase Continued Health Care Benefit Program (CHCBP) coverage for up to 36 months post-divorce. CHCBP is administered separately and is paid by the former spouse.

SGLI Beneficiary Update Urgency

Why Critical

Per VGLI policy and SGLI law, designated beneficiary inherits regardless of divorce. If your former spouse remains as SGLI beneficiary and you die before update, the former spouse receives the proceeds. Your subsequent spouse, children, or other intended beneficiary has no legal claim.

How to Update

• Marine Online > SGLI section > beneficiary update.
• Or VA Form SGLV 8286 through S-1.
• Update is immediate upon submission.

Timing

Update SGLI THE SAME DAY you submit NAVMC 10922NAVMC 10922. Do not wait.

Common Outcome When Forgotten

Service members die in incidents (combat, accident, illness) and former spouses receive SGLI proceeds. Survivors (current spouse, children) face legal battles with little recourse. The designation is binding.

Child Custody and BAH-Diff Implications

Joint Custody

If you and former spouse share custody, BAH calculation depends on which parent pays for housing and dependent care. Court order specifics matter.

Sole Custody to Marine

BAH-with-dependents continues for the children.

Sole Custody to Former Spouse

BAH-with-dependents stops. BAH-Diff may apply if you pay court-ordered child support exceeding the BAH-Diff threshold (currently set per DoD FMR).

Court-Ordered Support Documentation

• Submit court order to S-1.
• Court order amount must exceed BAH-Diff threshold to qualify.
• Annual recertification of court-ordered support.

USFSPA Former Spouse Considerations

What USFSPA Does

The Uniformed Services Former Spouses Protection Act (10 USC 140810 USC 1408) allows state courts to treat military retired pay as marital property in divorce proceedings.

When USFSPA Applies

• Marriage during qualifying military service.
• State court divorce decree includes military retired pay division.
• Military retiree status (or projected status if active duty).

Marine's Action

• Read divorce decree carefully for retired pay division language.
• Coordinate with Legal Services for USFSPA implications.
• DFAS Form 2293 (Application for Former Spouse Payments from Retired Pay) if applicable.

Former Spouse Retirement Pay Share

If the divorce decree awards a share of retired pay to the former spouse, DFAS handles direct payment. Marine receives the remaining share.

Former Spouse 20/20/20 and 20/20/15 Rules

20/20/20 Rule

Per 10 USC 107210 USC 1072, former spouse retains FULL military benefits (TRICARE, commissary, exchange, USIP card) if ALL THREE conditions met.

• 20+ years of marriage
• 20+ years of creditable military service by the Marine
• 20+ years of overlap between marriage and service

20/20/15 Rule

Former spouse retains LIMITED TRICARE benefits (one year only post-divorce) if these conditions met.

• 20+ years of marriage
• 20+ years of creditable military service
• 15+ years (but less than 20) of overlap

Marine's Action for 20/20/20 or 20/20/15

• Coordinate with S-1 and Legal Services.
• Former spouse retains DEERS enrollment under former spouse status.
• Former spouse obtains former spouse USIP card (different from dependent USIP).

Common Misunderstanding

Many Marines assume divorce ends ALL former spouse benefits. The 20/20/20 and 20/20/15 rules can preserve benefits for qualifying former spouses regardless of any agreement between the parties.

Common Errors

Using Interim or Separation Orders

Only the FINAL divorce decree counts. Interim orders, separation agreements, and pendente lite orders do not establish divorce for dependent removal purposes.

Late Submission Creating BAH Debt

Marines often delay submission while emotional from divorce. Each pay period of late submission creates BAH overpayment. The debt is recouped from future LES.

SGLI Not Updated

The most common and most consequential error. Update immediately upon receipt of final decree.

Failure to Return ID Card

Former spouse retains USIP card past the eligible period. This is misuse of a federal ID card and can have legal consequences for the former spouse.

Failure to Coordinate USFSPA

Marines miss USFSPA elections or fail to coordinate with DFAS, creating retirement pay disputes years later.

Failure to Update Beneficiaries Across Systems

SGLI is the most critical, but also update.

• TSP beneficiary designation.
• Will and estate planning documents.
• Bank account beneficiaries (POD/TOD).
• Insurance policies (private).
• Emergency contact in MOL.
