When a reservist is injured during inactive duty status (drill, AT, FHD, etc.), Line of Duty (LOD) determination establishes whether the injury occurred in qualifying duty. LOD-positive determinations open access to.

When LOD Investigation Triggers

Per MCRAMM Chapter 6 and JAGMAN, an LOD investigation is required when.

Qualifying Duty Status for LOD

Coverage Categories Following LOD Determination

LOD-Positive (Injury In Line of Duty)

The reservist receives.

• Medical care at military treatment facility (MTF) or VA
• Continued treatment until determined fit or unfit for duty
• Incapacitation pay if injury prevents civilian employment per DoDI 1241.01DoDI 1241.01
• Disability evaluation if condition warrants
• Continued status as drilling reservist until determination

LOD-Negative (Injury Not In Line of Duty)

The reservist receives.

• No military medical coverage for the injury
• Civilian insurance is the primary coverage
• Might still continue drilling if able
• Might separate or transfer based on condition

LOD-Pending

While investigation is open.

• Initial medical care typically authorized
• Continued coverage subject to investigation outcome

Performance Steps for LOD Processing

Step 1 - Identify the Incident

When an injury occurs.

• Document the incident immediately with witnesses
• Identify the duty status at time of injury
• Notify the chain of command
• Begin medical care as needed

Step 2 - Initiate Investigation

Per JAGMAN.

• Convening authority orders investigation
• Investigating officer appointed
• Investigation begins documentation gathering
• Witnesses interviewed
• Medical evaluation completed

Step 3 - Document the Duty Status

The investigation establishes.

• Was the reservist in qualifying duty at time of injury?
• Were there any deviations from authorized duty?
• Was misconduct involved?
• What was the cause of injury?

Step 4 - Complete Investigation Report

The investigation report includes.

• Findings of fact
• Determination of duty status at time of injury
• Determination of misconduct involvement (if any)
• Recommended LOD determination
• Supporting evidence

Step 5 - Forward for Final Determination

Incapacitation Pay

Per 10 USC 1230210 USC 12302 and DoDI 1241.01DoDI 1241.01, an LOD-positive reservist might receive incapacitation pay when.

• Injury or illness prevents performance of military duty
• Injury or illness prevents civilian employment
• Reservist would otherwise have earned civilian income

Incapacitation pay matches what the reservist would have earned in civilian employment, up to specified limits.

Common Errors on LOD Processing

These hit at the I&I shop and unit level.

1. Investigation delayed. Documentation gets stale. Witnesses become unavailable. Begin investigation immediately upon injury.
2. Witnesses not interviewed promptly. Memories fade. Interview while events fresh.
3. Status documentation insufficient. Does not prove qualifying duty at time of injury. Maintain detailed muster and accountability records.
4. Misconduct evaluation skipped. If reservist's misconduct contributed to injury, this affects LOD determination. Investigation must address.
5. Member coordination failed. Member is injured and uncertain about coverage. Communicate clearly throughout the process.

Pre-Mobilization Coverage

Per MCRAMM Chapter 12, reservists alerted for mobilization might receive pre-mobilization coverage.

• Medical and dental review before mobilization
• Coverage for conditions found during pre-mobilization screening
• Limited duration coverage to prepare for mobilization
• Different rules than LOD coverage for incidents during drill

Post-Mobilization Coverage (TAMP)
