What Qualifies as a Dependent

Per MCO 1751.3MCO 1751.3, a dependent for BAH purposes includes.

Spouse

• Legally married spouse
• Same-sex spouse (recognized in jurisdiction of marriage)
• Common-law spouse if recognized by state of legal residence
• Spouse legally separated may still qualify in specific circumstances

Children

• Biological children under age 21 (or 23 if full-time student)
• Adopted children with final adoption
• Stepchildren in member's household
• Court-ordered custodial children
• Disabled adult children with continuing dependency

Parents and Wards

• In specific circumstances per MCO 1751.3MCO 1751.3
• Requires specific qualifying conditions
• Less common than spouse and children

When With-Dependents Rate Applies

A Marine receives BAH at the with-dependents rate when.

• Has at least one qualifying dependent
• Dependent resides with member at duty station (or eligible separate location)
• Member is not in government quarters
• Documentation establishes dependent status (NAVMC 10922NAVMC 10922 with supporting docs)

Documentation Required

PAC processes with-dependents BAH only with proper documentation.

Performance Steps for With-Dependents BAH

Step 1 - Validate Dependent Documentation

When member submits NAVMC 10922NAVMC 10922.

• Verify all required supporting documents present
• Verify documents are originals or certified copies (not photocopies)
• Verify documents are properly executed
• Verify member identification on documents

Step 2 - Verify Dependent Resides at Duty Station

The dependent must reside at the member's duty station for standard with-dependents BAH.

• Verify family residence address
• Verify the address matches the duty station zip code area
• For dependents at separate location, evaluate BAH-Diff eligibility

Step 3 - Determine Effective Date

The BAH change effective date.

• Marriage: Date of marriage (not date of submission)
• Birth: Date of birth (not date of submission)
• Adoption: Date adoption finalized
• Other dependent: Per applicable triggering event

Step 4 - Process UD/MIPS Transaction

Apply the BAH change.

• UD/MIPS dependency transaction with effective date
• BAH category change to with-dependents

Step 5 - Coordinate Member ID and DEERS

Direct member to RAPIDS facility.

Common Errors

These hit during PAC processing.

1. Marriage processed but BAH not changed. NAVMC 10922NAVMC 10922 submitted but BAH category transaction missed. Fix by submitting separate BAH change.
2. Effective date wrong. BAH effective on submission date instead of marriage or birth date. Causes retroactive pay issues. Fix by reversing and resubmitting with correct date.
3. Dependent not in DEERS. Dependent processed for BAH but not enrolled in DEERS. Coordinate with member for RAPIDS visit.
4. Annual revalidation skipped. MARADMIN 661/19MARADMIN 661/19 cycle not completed. BAH may stop. Process revalidation.
5. Photocopy submitted as supporting document. Marriage cert or birth cert not certified copy. Reject and request original.

When With-Dependents BAH Stops

BAH stops or changes when.

• All dependents removed (divorce with no children, all children aging out)
• Member moves to government quarters
• Member separates or retires
• Dependency revalidation fails

BAH-Diff Comparison

BAH-Diff is different from with-dependents BAH.

• BAH-Diff: Member has dependents not at duty station (separated locations)
• BAH-Diff is a fixed rate, not zip-code based
• Less common but applies in specific situations
