MCO 1752.5C - Sexual Assault Prevention and Response (SAPR) Program

Scope

MCO 1752.5C sets Marine Corps Sexual Assault Prevention and Response (SAPR) Program policy. The order assigns responsibilities, prescribes procedural and training guidance, and frames sexual assault as a criminal act inconsistent with Marine Corps core values. SAPR is a commander's program with non-delegable duties requiring continuous oversight. NAVMC 1752.5 carries the SAPR procedural detail. All installation and operational commanders comply with the policies and procedures contained in the Order.

Audience

• Commanders at every level. SAPR oversight is non-delegable. Run the unit SAPR program, ensure training, and refer all reports to the supporting SARC.
• Sexual Assault Response Coordinators (SARCs). Civilian command SARCs are administratively sponsored by installation SARCs in coordination with MCCS Human Resources. Tenant commands authorized to appoint civilian SARCs.
• SAPR Victim Advocates (VAs). Every Marine air or ground unit at battalion or squadron level. Every MARFORRES site. Two minimum at formal learning centers. Certified through the Defense Sexual Assault Advocate Certification Program (D-SAACP).
• Medical Officers and Sexual Assault Forensic Examiners (SAFEs). Provide medical response.
• Staff Judge Advocates and trial counsel. Coordinate legal response and prosecution support.
• Chaplains. Receive Restricted Reports under their privileged communications role.
• Every Marine and attached service member. Receive annual SAPR training. Know the bystander intervention behaviors and reporting options.

Reporting options

The SAPR Program operates two reporting tracks per Appendix A, Chapter 1.

• Restricted Report. Confidential disclosure to a SARC, SAPR VA, healthcare personnel, or chaplain. Triggers SAPR services without notification to law enforcement or the command. Reverts to Unrestricted at the victim's request at any time.
• Unrestricted Report. Notification to command and law enforcement. Triggers the full investigative process. Drives the 8-Day Incident Report cycle.

Required reports

• SAPR 8-Day Incident Report, Report Control Symbol DD-1752-05. Commander submits within 8 days of an Unrestricted Report covering the case status, the support provided, and the actions taken. Detail at Enclosure 1 Chapter 3 paragraph 5.c.(3), Enclosure 1 Chapter 4 paragraph 4.a.(4), Enclosure 1 Chapter 4 paragraph 5.f., and Appendix C paragraph 3.g.

Records and retention

• SAPR records retain for 50 years regardless of whether the Service member filed Restricted or Unrestricted.
• DSAID is the DoD-wide system of record for sexual assault data.
• Records management per MCO 5210.11F and SECNAV M-5210.1.
